Specifically, Deputy Prime Minister of Vietnam Tran Hong Ha’s conclusion is as follows: according to reports of Ministries, it is feasible to use the acceleration of the progress of the promulgation of documents elaborating on the Law on Land 2024 as the basis for requesting the National Assembly of Vietnam to permit the early entry into force of the Law under the directive of the Prime Minister of Vietnam.
According to the Notification, the Minister of Natural Resources and Environment of Vietnam and the Minister of Construction of Vietnam are assigned to formulate applications for the development of the draft Resolution for presentation to the National Assembly of Vietnam for permission to adjust Clauses of the following laws for early entry into force:
- Law on Land 2024;
- Law on Housing 2023;
- Law on Real Estate Business 2023.
(The mentioned laws are initially intended to come into force as of January 1, 2025).
Such applications shall be submitted to the Ministry of Justice of Vietnam for appraisal before April 25, 2024 for presentation to the Government of Vietnam for assessment and decision according to the procedures prescribed in the Law on Promulgation of Legislative Documents.
After the presentation of the Ministry of Justice of Vietnam and the Standing Committee of the National Assembly of Vietnam agrees to add the relevant content to the program on the 7th meeting session of the National Assembly of Vietnam, the Minister of Natural Resources and Environment of Vietnam and the Minister of Construction of Vietnam shall proactively formulate applications for adjustments to Clauses for early entry into force of the Law on Land, Law on Housing, and Law on Real Estate Business.
**Before May 10, 2024, the Ministries of Natural Resources and Environment, Finance, and Agriculture and Rural Development of Vietnam shall complete draft Decrees and present them to the Government of Vietnam following the procedures prescribed in the Law on Promulgation of Legislative Documents. Within 7 days, the Government of Vietnam shall assess and issue decisions following its working regulations.
Draft Decrees shall ensure the principles of adequate elaboration on the Law on Land 2024 and assignment of the Government of Vietnam to provide elaboration; ensure constitutionality, legality, and consistency among land, housing, real estate business, finance, and agriculture laws and other relevant laws; ensure the consistency among Decrees; carry out the decentralization and authorization while ensuring conditions and criteria for local implementation, which are the grounds for supervision and inspection; carry out digital transformation in the management and provision of public services, etc.
