Guidance on implementation of regulations on increasing overtime hours

April 26, 2022, the Ministry of Labor - War Invalids and Social Affairs promulgated Official Dispatch No. 1312/LDTBXH-ATLD on guidance on implementation of Decree No. 17/2022/UBTVQH15 on increasing overtime hours in the context of economic recovery.

According to Official Dispatch No. 1312/LDTBXH-ATLD , the Ministry of Labor – War Invalids and Social Affairs requests provinces and centrally affiliated cities to pay attention to the following contents:

- Cases, where employers may assign their employees to work overtime for a maximum time of 300 hours per year, are prescribed in Clause 1 Article 1 of Decree No. 17/2022/UBTVQH15 and Clause 3 Article 107 of the Labor Code.

- Cases eligible for the maximum time of 300 overtime hours per year are also eligible for 40 to 60 overtime hours per month as of April 1, 2022.

- Full compliance with other regulations on overtime hours in the Labor Code and guiding documents of the Labor Code.

- When organizing overtime work from over 200 to 300 hours per year, employers must notify the Department of Labor – War Invalids and Social Affairs as prescribed in Clause 4 Article 107 of the Labor Code and Article 62 of Decree No. 145/2020/ND-CP of the Government.

- Regulations of Decree No. 17/2022/UBTVQH15 shall be complied with until the end of December 31, 2022, unless their implementation time is extended by the National Assembly.
