The following construction contracts are promulgated together with the Circular:
- Construction advisory contract;
- Construction execution contract;
- Engineering - Procurement - Construction contract (EPC).
The contracts mentioned above are contracts between investors and contractors.
If the awarding party is the general contractor or main contractor, research parties shall utilize the necessary contents of contract forms to establish and manage the contract performance.
When using contract forms according to Circular No. 02/2023/TT-BXD to make agreements or conclude construction contracts, related parties shall follow the specific request and condition of the procurement package, project, and regulations of relevant documents to comply with:
+ Decree No. 37/2015/ND-CP (amended by Decree No. 50/2021/ND-CP);
+ Relevant regulations of laws and contents according to the guidance of Circular No. 02/2023/TT-BXD.
Circular No. 02/2023/TT-BXD comes into force as of April 20, 2023.
