More authorities permitted to determine scope of border checkpoint areas in Vietnam

On June 16, 2023, the Government of Vietnam promulgated Decree No. 34/2023/ND-CP on amendments to Decree No. 112/2014/ND-CP on management of land border checkpoints.

According to the Decree, authorities competent to determine the scope of border checkpoint areas, border crossings, customs clearance routes, roads designed for goods transport, and construction planning for border checkpoint areas and border crossings include:

(1) The Government of Vietnam: decide on the approval of the scope of international border checkpoints, main checkpoints (bilateral border checkpoints); customs clearance routes, and roads designed for goods transport. (previously unregulated)
 
(2) People’s Committees of bordering provinces shall:

- Decide on the approval of the scope of alternative border checkpoint areas (local border checkpoints) and border crossings;

- Take charge and cooperate with the Ministry of National Defense of Vietnam, Ministry of Public Security of Vietnam, Ministry of Finance of Vietnam, Ministry of Industry and Trade of Vietnam, Ministry of Health of Vietnam, Ministry of Natural Resources and Environment of Vietnam, Ministry of Agriculture and Rural Development of Vietnam, and Ministry of Construction of Vietnam in determining the scope of international border checkpoints, main checkpoints (bilateral border checkpoints); customs clearance routes and roads designed for goods transport and submitting reports to the Government of Vietnam for decisions;

- Take charge and cooperate with the Ministry of National Defense of Vietnam, Ministry of Public Security of Vietnam, Ministry of Finance of Vietnam, Ministry of Industry and Trade of Vietnam, Ministry of Construction of Vietnam, Ministry of Transport of Vietnam, Ministry of Planning and Investment of Vietnam, and Ministry of Natural Resources and Environment of Vietnam in preparing and appraising the construction planning for areas of international border checkpoints and main border checkpoints (bilateral border checkpoints) and presenting it to the Prime Minister of Vietnam for approval;

- Prepare, appraise, and approve the planning for construction subdivisions and detailed construction planning for areas of international border checkpoints and main border checkpoints (bilateral border checkpoints);

- Prepare, appraise, and approve the construction planning for alternative border checkpoint areas (local border checkpoints) and border crossings.

(3) Commands of Provincial Border Guards shall take charge and cooperate with provincial departments and authorities: Commands of Military, Public Security, Foreign Affairs, Industry and Trade, Health, Customs, Agriculture and Rural Development, Planning and Investment, Construction, Finance, Transport, Natural Resources and Environment, and District-level People's Committees with alternative border checkpoints (local border checkpoints) and border crossings in determining the areas of alternative border checkpoints (local border checkpoints) and border crossings and submitting reports to Provincial People's Committees for decisions.

Decree No. 34/2023/ND-CP of the Government of Vietnam comes into force as of July 31, 2023.
