DECISION
PROMULGATING LIST OF KEY ENERGY USING FACILITIES IN 2023
THE PRIME MINISTER
Pursuant to the Law on
Government Organization of Vietnam dated June 19, 2015; Law on amendments to
some articles of the Law on Government Organization of Vietnam and Law on Local
Government Organization of Vietnam dated November 22, 2019;
Pursuant to the Law on
Economical and Efficient Use of Energy dated June 28, 2010;
Pursuant to the
Government's Decree No. 21/2011/ND-CP dated March 29, 2011 on elaboration and
provision of measures for enforcing Law on Economical and Efficient Use of Energy;
At the request of the
Minister of Industry and Trade.

Article 2.
Implementation
1. Ministry of Industry
and Trade:
a) Preside over and
cooperate with relevant ministries, central and local authorities in management
of energy use by key energy using facilities according to regulations of the
Law on Economical and Efficient Use of Energy and the Government’s Decree No.
21/2011/ND-CP dated March 29, 2011;
b) Preside over and
cooperate with relevant ministries and central authorities and People's
Committees of provinces and central-affiliated cities in updating the list of
key energy using facilities and submitting the updated list to the Prime
Minister for promulgation and public announcement before March 31 every year;
c) Be responsible for the
accuracy and sufficiency of the list of key energy using facilities and ensure
that these facilities are conformable with regulations in clause 1 Article 6 of
the Government’s Decree No. 21/2011/ND-CP dated March 29, 2011.
2. People's Committees of
provinces and centrally-affiliated cities:
a) Instruct relevant
local government authorities to give notification to key energy using
facilities located within their provinces and included in the list provided in
the Appendix issued thereto and manage and monitor programs for economical and
efficient use of energy run by such facilities;
b) Instruct local
specialized agencies to check, review and make their lists of local key energy
using facilities and send a consolidated list to the Ministry of Industry and
Trade before February 01 every year.
3. State-owned
corporations:

b) Review and update the
list of key energy using facilities under their management and send a
consolidated report to the Ministry of Industry and Trade before February 01
every year.
4. Key energy using facilities
included in the list provided in the Appendix issued thereto shall perform all
their duties specified in the Law on Economical and Efficient Use of Energy,
the Government’s Decree No. 21/2011/ND-CP and other relevant legislative
documents.
Article 3. This
Decision comes into effect from the date on which it is signed.
Article 4. Ministers, Heads of ministerial agencies and Governmental
agencies, Presidents of People’s Committees of provinces and central-affiliated
cities, the heads of state-owned corporations and energy using facilities
included in the list of key energy using facilities shall be responsible for
implementing this Decision./.
