New regulations of Vietnam on the supplement to documents valid for entry and exit at land border checkpoints

On November 21, 2022, the Minister of National Defense of Vietnam promulgated Circular No. 82/2022/TT-BQP guiding Decree No. 96/2020/ND-CP on imposition of fines for administrative violations in the sector of national border management and protection and Decree No. 37/2022/ND-CP on amendments to the Decree on imposition of fines for administrative violations in the sector of national border management and protection; on the waters, islands, and continental shelf of the Socialist Republic of Vietnam.

Specifically, Point e Clause 5 Article 6 of Decree No. 96/2020/ND-CP stipulates a fine ranging from 3.000.000 VND to 5.000.000 VND for acts of letting other people use entry and exit documents to enter and exit at border checkpoints.

Circular No. 82/2022/TT-BQP provides guidelines on documents valid for entry and exit at border checkpoints, including:

- Vietnam - China border route:

Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.

- Vietnam - Laos border route:

Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.

- Vietnam - Cambodia border route:

Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.

(Circular No. 82/2022/TT-BQP has added the requirement for e-passports and e-visas compared to Circular No. 173/2020/TT-BQP).

Circular No. 82/2022/TT-BQP comes into force as of January 8, 2023 and replaces Circular No. 173/2020/TT-BQP dated December 30, 2020.
