On November 21, 2022, the Minister of National Defense of Vietnam promulgated Circular No.
82/2022/TT-BQP guiding Decree No.
96/2020/ND-CP on imposition of fines for administrative violations in the sector of national border management and protection and Decree No.
37/2022/ND-CP on amendments to the Decree on imposition of fines for administrative violations in the sector of national border management and protection; on the waters, islands, and continental shelf of the Socialist Republic of Vietnam.
Specifically, Point e Clause 5 Article 6 of Decree No. 96/2020/ND-CP stipulates a fine ranging from 3.000.000 VND to 5.000.000 VND for acts of letting other people use entry and exit documents to enter and exit at border checkpoints.
Circular No. 82/2022/TT-BQP provides guidelines on documents valid for entry and exit at border checkpoints, including:
- Vietnam - China border route:
Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.
- Vietnam - Laos border route:
Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.
- Vietnam - Cambodia border route:
Passports; e-passports; visas; e-visas; documents valid for international travel; laissez-passers; APEC Business Travel Cards (ABTC); temporary residence cards; permanent resident cards; visa exemption certificates.
(Circular No. 82/2022/TT-BQP has added the requirement for e-passports and e-visas compared to Circular No. 173/2020/TT-BQP).
Circular No. 82/2022/TT-BQP comes into force as of January 8, 2023 and replaces Circular No. 173/2020/TT-BQP dated December 30, 2020.
