Vietnam to provide guidelines for the Criminal Code on crimes related to military weapons and explosives

This is the content of Resolution No. 03/2022/NQ-HDTP guiding the application of several regulations prescribed in Article 304, Article 305, Article 306, Article 307, and Article 308 of the Criminal Code promulgated by the Council of Judges of the Supreme People's Court on September 9, 2022.

According to the Resolution, guidelines on several circumstances that are signs of criminal offenses related to military weapons and explosives are as follows:  

- “Illegal manufacturing of military weapons or devices” according to Clause 1 Article 304 of the Criminal Code:

Is the manufacturing or assembly of military weapons or devices from detailed parts of military weapons or devices, usable according to their functions and effects without the permission of competent authorities, etc.

- “Illegal manufacturing of explosives” according to Clause 1 Article 305 of the Criminal Code:

Is the act of making, processing, or mixing to create explosives without the permission of competent agencies or persons.

- Regulations on acts of illegally storing, transporting, using, trading, or appropriating explosives” according to Clause 1 Article 305 and regulations on “illegally storing, transporting, using, trading, or appropriating hunting rifles, cold weapons, sporting weapons, or combat gears" according to Clause 1 Article 306 of the Criminal Code shall be applied according to guidelines prescribed in Clauses 2, 3, 4, 5, and 6 Article 3 of Resolution No. 03/2022/NQ-HDTP.
