Proposed schemes for Lunar New Year Holiday and National Day Holiday 2024 in Vietnam

On October 27, 2023, the Ministry of Labor – War Invalids and Social Affairs of Vietnam promulgated Official Dispatch No. 4594/LDTBXH-ATLD on proposed schedules for the Lunar New Year Holiday and the National Day Holiday 2024.

** Proposed scheme for the Lunar New Year Holiday 2024:

- Regarding officials and public employees: the Ministry of Labor - War Invalids and Social Affairs of Vietnam proposes 5 days off for the Lunar New Year Holiday as per regulation with the consent of most of the concerned Ministries and central authorities, with 2 days off before Tet and 3 days off after Tet.

Officials and public employees shall enjoy the Lunar New Year Holiday 2024 from Thursday, February 8, 2024 of the Gregorian Calendar to the end of Wednesday, February 14, 2024 of the Gregorian Calendar (which is December 29 of the Moon Calendar of the Year of the Cat to the end of January 5 of the Moon Calendar of the Year of the Dragon).

With this scheme, officials and public employees will have 7 days off for the Lunar New Year Holiday (including 5 days off for the Lunar New Year Holiday and 2 compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code).

- Regarding employees: select 1 day before Tet and 4 first days after Tet or 2 days before Tet and 3 first days after Tet or 3 days before Tet and 2 days after Tet.  Employers shall notify employees of the scheme for the Lunar New Year Holiday schedule before implementation at least 30 days in advance.  

**Proposed scheme for the National Day Holiday 2024:

- Regarding officials and public employees: the Ministry of Labor – War Invalids and Social Affairs of Vietnam proposes 4 consecutive days off from Saturday, August 31, 2024 to the end of Tuesday, September 3, 2024, including 2 days off for the National Day Holiday and 2 weekly days off.

According to the Ministry of Labor - War Invalids and Social Affairs of Vietnam, scheme 1 does not require any administrative procedure and arrangement of compensatory days off for the weekly days off according to Clause 3 Article 111 of the Labor Code 2019 (scheme 1 is consensually agreed on by every concerned Ministry and central authority).

- Regarding employees in industrial zones, the Ministry of Labor – War Invalids and Social Affairs of Vietnam requests employers to arrange the schedules for the Lunar New Year Holiday and the National Day Holiday in compliance with the Labor Code 2019.

According to the Ministry of Labor – War Invalids and Social Affairs of Vietnam, regarding the National Day Holiday, employers shall let employees have 2 days off (September 2 of the Gregorian calendar and an adjacent day before or after the mentioned date).

Employers shall notify employees of the scheme for the Lunar New Year Holiday schedule before implementation at least 30 days in advance.  

If the weekly days off coincide with the days off for the Lunar New Year Holiday or National Day Holiday, employers shall arrange compensatory days off for employees on the next working days according to Clause 3 Article 111 of the Labor Code 2019.
