2 more nations eligible for special preferential import tariff rates according to RCEP Agreement from December 1, 2023 in Vietnam

On December 1, 2023, the Government of Vietnam promulgated Decree No. 84/2023/ND-CP on amendments to Decree No. 129/2022/ND-CP on Vietnam’s special preferential import tariff schedule for implementation of the Regional Comprehensive Economic Partnership during 2022-2027.

Decree No. 84/2023/ND-CP has amended Decree No. 129/2022/ND-CP regarding the regulation on imports eligible for special preferential import tariff according to the RCEP Agreement must meet the following conditions:

- They are included in the special preferential import tariff schedule promulgated together with Decree No. 129/2022/ND-CP.

- They are imported into Vietnam from member states of the RCEP Agreement, including the following countries and territories:
+ Brunei Darussalam;

+ Kingdom of Cambodia;

+ Republic of Indonesia;

+ Lao People's Democratic Republic;

+ Malaysia;

+ Republic of Singapore;

+ Kingdom of Thailand;

+ Australia;

+ The People’s Republic of China (or China);

+ The Republic of Korea (or Korea);

+ Japan;

+ New Zealand;

+ Republic of the Union of Myanmar (addition);

+ Republic of the Philippines (addition).

- They meet origin criteria (including regulations on direct consignment) and are supported by valid proofs of origin as prescribed in the RCEP Agreement and current laws.

Attention: Regarding imports from the Republic of the Union of Myanmar and customs declarations of imports from March 4, 2022, imports from the Republic of the Philippines and customs declarations of imports from June 2, 2023 to before December 1, 2023, if they meet the requirements for eligibility for RCEP rates according to Decree No. 84/2023/ND-CP and Decree No. 129/2022/ND-CP and have paid a higher tax rate, customs authorities shall settle the overpaid tax according to tax administration laws.
